Terms of Service
Please read these terms carefully before creating or using a CM5 Wallet. By accessing the service, you accept all of the terms below.
1. Purpose and nature of the service
CM5 Wallet is a non-custodial cryptocurrency wallet operated by CM5 Markets. "Non-custodial" means CM5 Markets never holds, controls, or has access to your private keys or funds: you, the user, retain exclusive control over your digital assets at all times.
The service lets you generate receiving addresses, receive, send and swap cryptocurrencies across multiple blockchain networks, and view your transaction history. CM5 Wallet operates independently from any CM5Markets trading account: the creation, suspension or closure of a trading account has no effect whatsoever on access to your Wallet or your funds.
CM5 Wallet is available to anyone of legal age, with no requirement to otherwise be a CM5Markets client.
2. Account creation and eligibility
- You must be at least 18 years old, or the legal age of majority applicable in your jurisdiction, to create a Wallet.
- You warrant that the information provided when creating your account (in particular your email address) is accurate and belongs to you.
- Creating an account on behalf of a third party without their explicit authorization, or using the service for fraudulent purposes, money laundering, or financing of illegal activities, is prohibited.
- CM5 Markets reserves the right to refuse account creation or suspend an existing account in the event of reasonable suspicion of a breach of these terms.
3. Private key and user responsibility
Your private key is the only way to access your assets. It is encrypted and never transmitted in plain form to our servers, nor accessible to CM5 Markets staff.
- You are solely responsible for safeguarding, keeping confidential, and backing up your private key and login credentials.
- If your private key is compromised, or you suspect it may be, you can reset it at any time from your account settings, which generates a new key without affecting the assets you already hold. CM5 Markets cannot be held liable under any circumstances for the consequences of a failure on your part to protect your private key.
- Never share your private key, even with a CM5 Markets support team member — they will never ask you for it.
- You are responsible for all activity carried out from your account, including in the event of unauthorized access resulting from a failure to protect your credentials.
4. Blockchain transactions and irreversibility
Any transaction broadcast and confirmed on a blockchain is final and irreversible. It is your responsibility to carefully verify the destination address, the chosen network, and the amount before confirming a send or withdrawal.
CM5 Wallet cannot cancel, intercept, or refund a transaction sent to a wrong address, an incompatible network, or a non-existent contract. In the event of an error on your part, funds may be permanently lost.
Confirmation times depend on the blockchain network used and its congestion at the time, factors outside CM5 Markets' control.
5. Fees
Network fees ("gas"), which vary depending on the blockchain and its congestion at the time of the operation, as well as any applicable service fees, are displayed before any transaction is confirmed.
Once a transaction has been validated and broadcast on the blockchain, the fees incurred are final and non-refundable, including in the event the transaction fails for a reason unrelated to CM5 Wallet (e.g. network congestion, rejected contract).
6. Swap feature and third-party services
The cryptocurrency swap feature may rely on liquidity providers or third-party services. Displayed rates are indicative and may vary slightly between the time they are shown and actual execution, depending on market conditions.
CM5 Markets is not responsible for rate variations, execution delays, or temporary unavailability of a third-party service used as part of a swap.
7. Account security
CM5 Wallet provides security mechanisms including two-factor authentication (2FA), connected device management, and login alerts. Enabling and maintaining these protections is your responsibility.
In the event of suspected fraudulent activity or unauthorized access, CM5 Markets may temporarily suspend access to an account for protective purposes, without affecting your ownership rights over the assets held, which remain accessible via your private key.
8. Risks associated with digital assets
Cryptocurrencies are digital assets whose value is highly volatile and not guaranteed. CM5 Wallet is a technical tool for storage and transfer: it does not constitute investment advice, a financial recommendation, or a guarantee of return under any circumstances.
You acknowledge that you understand the risks inherent to digital assets (volatility, technological risks, regulatory changes) and you alone bear the consequences of your decisions to use the service.
9. Limitation of liability
To the extent permitted by applicable law, CM5 Markets shall not be liable for direct or indirect losses resulting from: a data entry error on your part, a failure to protect your private key or credentials, an outage or congestion of a blockchain network, a temporary unavailability of the service for maintenance, or an event of force majeure.
10. Changes to these terms
CM5 Markets may modify these terms at any time, in particular to reflect regulatory or functional changes to the service. Material changes will be notified to you within the application. Continued use of the service after notification constitutes acceptance of the new terms.
